Mini Mascot terms and conditions

1 GENERAL TERMS

1.1 The online competition “Mini Mascots” (the 'Competition') is offered by the British Olympic Association, (‘the Company”) whose registered address is: 101 New Cavendish St, London W1W 6XH.

1.2 By entering the Competition, the entrant agrees to be bound by these terms and conditions. For the avoidance of doubt, this set of terms and conditions shall override any general competition terms and conditions on the Company’s website.

1.3 The purpose of the Competition is to select five children as Team GB ‘Mini Mascots’ to take part in several promotional activities for Team GB ahead of the 2024 Paris Olympic Games. This will include but is not limited to; Team GB photoshoots and activity; attendance and participation at key milestone moments and events such as ‘Kitting Out’ and ‘Team GB departure’; and transportation to a variety of Team GB activities through the period between October 2023 and June 2024.

1.4 This Competition is open to residents of the United Kingdom including the Isle of Man and Channel Islands, aged 18 or over and on behalf of a child aged between 5-11.

1.5 Through this Competition entry process, we will be choosing four of the five Mini Mascots. The fifth Mini Mascot will be chosen through a separate entry process via the Get Set program “Path to Paris”. You can find out more about this by visiting Path to Paris.

1.6 No purchase is necessary; however, internet access and access to www.teamgb.com/mascot (the ‘Site’) are required.

1.7 Competition Period: Entries for the contest will be accepted until the time outlined on our competition page.

1.8 To Enter: Fill in the form at Team GB Mascot to be in with the chance to be selected to nominate a child.

1.9 The Shortlist: 40 shortlisted Entrants will be selected at random and then have until 23.59 BST on 22.09.23 to respond and until 23.59 BST on 09.10.23 to submit their additional requested content, which will be judged by a Team GB judging panel.

1.10 The Finalists: The final four winners selected via this process will be contacted by Team GB and have 7 days on receipt to claim their prize (prize details listed in clause 3 below). If a response is not received within this timeframe, then the prize will be passed onto the next shortlisted entry.

1.11 Costs: As a basis, costs for travel, accommodation (where necessary) and kit for any activities that are part of the Team GB Mini Mascots program will be covered by the British Olympic Association. This will cover the chosen child and one adult to chaperone them. The British Olympic Association shall in its sole discretion determine the standard of accommodation and travel and shall only be obliged to cover reasonable costs. Other requirements will be considered on a case-by-case basis.

1.12 Entries to the Competition can only be made via a dedicated microsite where adults are able to confirm interest and nominate children within the ages of 5 and 11 years old to be considered to be one of five Team GB Mini Mascots. No applications to enter made in any other manner will be accepted. Where an application has been submitted, it will be known as an “Entry”, and you will become known as an “Entrant” in the terms below.

1.13 When an Entrant enters the Competition, they agree to these Terms and Conditions on behalf of the Mascot Applicant (as defined at clause 2.1 below). If the Entrant does not agree with any of these Terms and Conditions, they should not enter the Competition, because by entering the Competition an Entrant will be deemed to have irrevocably agreed to these Terms and Conditions.

1.14 Please note that these Terms and Conditions may be revised and reissued without notice at any time by updating this posting and the Entrant shall agree that no liability shall attach to the Company and that they have no right to claim any compensation as a result thereof.

1.15 The Company will assume (and by entering the Competition the Entrant will warrant that) that any Entrant shall have legal capacity to enter into the agreement set out in these Terms and Conditions (i.e. that each Entrant is of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract).

2 ELIGIBILITY

2.1 Entrants must be over 18 years of age and enter on behalf of children who must be aged between 5 and 11 years old (inclusive) at the point at which the competition closes on 13th September 2023 (‘the Mascot Applicant’) to be eligible to win.

2.2 Entry into the Competition is open to UK residents. Employees (and their immediate families) of the Company and any of their subsidiaries, group companies and/or agencies are ineligible to enter the Competition.

2.3 The Company reserves the right to refuse to accept any Entry which, in its opinion, does not comply with the Terms and Conditions of the Competition.

2.4 The Company has absolute discretion to disqualify any Entry, or vary, amend or waive the rules of the Competition at any time and Entrants agree that no liability shall attach to the Company as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any Entrant. It is a condition of Entry that all rules are accepted as final, and that the Entrant agrees to abide by these rules.

3 COMPETITION ROUNDS AND PRIZE

3.1 All valid applications received during the Competition Period will be entered into a prize draw with 40 Entrants picked at random to be shortlisted for the second stage of the Competition.

3.2 The second stage of the Competition will require a short video clip of the Mascot Applicant explaining why they should be part of Team GB.

3.3 The video should be no longer than 60 seconds long and needs to be in a recognisable video format such as MP4 or MOV.

3.4 All valid video entries received during the period from 26.09.23 – 09.10.23 will be judged by a judging panel made up of Team GB Staff, members of the Team GB Athlete Commission and Mischief (the third party agency helping the Company with administration of the Competition). The four winners will be announced by 20.10.23.

The judging panel will select 4 winning entries who achieve the highest score based on the following criteria:

a) Unique – how unique is the entry and does it stand out from other entries? (Scored out of 10)

b) Passion – how passionate is the entry about Team GB and the Olympics? (Scored out of 10)

c) Energy – how upbeat is the entry? (Scored out of 10)

3.5 The Company reserves the right to name fewer than 4 winners if fewer than 4 meet the minimum scoring threshold of 10 points or more.

3.6 The provisional winners will then be contacted via email. Reasonable efforts will be made to contact the provisional winners. Once the prize has been accepted, the provisional winners will be confirmed as winners. If a provisional winner does not respond to the initial contact within 7 days, the Company reserves the right to disqualify that Entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

3.7 Fulfilment of the prize will take place between October 2023 to September 2024. In the unlikely event that a winner has not received communication to provide details of the prize, the winner must inform the Company by emailing [email protected]

3.8 Winners agree that neither the Company nor its employees shall have any liability in connection with the acceptance or use of any of the prizes.

3.6 All winners by accepting any prize as a result of an Entry will agree to take part in any publicity associated with the winning of such prize, including but not limited to attending a photoshoot in 2023 or early 2024 (exact date to be confirmed). This publicity can be used by the British Olympic Association and supporting agencies. As the winner(s) is/are under the age of 18, it is a condition of accepting any prize that consent be provided by a parent or guardian for the winner to take part in such publicity. If consent is given the winner and/or their parent/guardian acting on behalf of the winner shall assign to the Company all rights of whatsoever nature, including all copyright and grant all further consents or licences necessary to enable the fullest use of any intellectual property throughout the world without any time limit by any and all means in any and all media, whether now known or hereafter developed, without liability or acknowledgement.

4 OBLIGATIONS AND THE LIMITS ON LIABILITY

4.1 The Company agrees to use its reasonable endeavours to maintain the Site in a fully operating condition and error free. As the Company cannot guarantee that the Site will always be fully operational or error free, they do not accept responsibility for any defects that may exist or for any costs or losses arising from an Entrant’s use of or inability to access the Site.

4.2 Whilst the Company takes reasonable precautions to ensure that any downloads it makes available will be virus free the Company do not warrant that any downloads will be virus free and will not cause interruptions with Entrant’s computer systems.

4.3 The Company excludes, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability for any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the use of the Site or their unavailability. This exclusion shall apply in respect of, without limitation, any interruption of services, lost profits, loss of contracts or business opportunity, loss of data, or any other consequential, incidental, special, or punitive damages arising out of the Site, even if the Company has been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise.

5 INDEMNITY

5.1 Entrants agree to indemnity and keep indemnified the Company and their officers, directors, employees, agents, distributors and affiliates from and against any and all claims loss damage or liability (whether criminal or civil) suffered and fees and costs incurred, including reasonable legal fees, resulting from any act neglect or default or breach by an Entrant or any person who may be authorised by any Entrant or for whom an Entrant is responsible of any of these Terms and Conditions and/or from an Entrant’s placement or transmission of any content onto the Company's servers, and/or from any and all use of an Entrant’s account.

6 INTELLECTUAL PROPERTY

6.1 The rules and the Competition are all copyright of the Company. No information may be reproduced in any format without prior written consent from the Company. The British Olympic Association and associated marks are registered trademarks of the Company and may not be used without permission.

7 SEVERABILITY

7.1 If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein.

8 JURISDICTION

8.1 These Terms and Conditions shall be governed by and construed in accordance with English law.

8.2 Entrants agree that all claims arising from their participation in the Competition which they may bring against the Company will be under the exclusive jurisdiction of the English Courts.

9 MODERATION

9.1 The Company reserves the right to reject entries which, in the reasonable opinion of the Company: a) Are in breach of the Terms & Conditions; b) Contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Company or any commercial partner of the Company; c) contains or refers to any unauthorised third-party brand or reference any third-party names, logos and/or trademarks; d) promotes any political agenda; or e) includes use of trademarks, logos, or copyright material not owned by you or used without the rights owner's prior written permission (including famous names, company names, etc.

9.2 Provided no objection is received from the winners, a winners list containing the surname and county of residence of the winners will be made available by the Company 4 weeks after the close of the Competition Period, for a period of 8 weeks. It will be available by sending a request via email to [email protected].

9.3 Winners can object to their details being published by emailing [email protected]

9.4 Without prejudice, the Company will provide winner information to the Advertising Standards Authority if requested by them.

9.5 The Company seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Company reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Company reserves the right at any point to:

a) Verify the eligibility of entrants and/or provisional winners by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.

b) Disqualify entries that are not made directly by the individual entering the Competition.

c) Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

d) Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.

e) Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.

f) Disqualify entrants who tamper with the entry process.

g) Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.

h) Cancel, modify or suspend the Competition should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

9.6 All personal data supplied for this Competition will be used solely for the purpose of this Competition by the Company and/or by any agent appointed by it to assist with running the Competition and will not be disclosed to an unconnected third party unless your express consent has been obtained. Your personal data will be handled in accordance with the Company’s privacy policy.

9.7 If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

9.8 By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.

9.9 If there is a discrepancy between these Terms & Conditions and those in any Competition material, these Terms & Conditions will prevail.
